1. Agreement
These terms govern use of Rally at rally.sentinelgrid.us. By hosting a game or joining one, you agree to them. If you are agreeing on behalf of a school or district, you confirm you are authorised to do so.
Where a school has a signed services agreement with SentinelGrid that addresses the same subject, that agreement controls and these terms fill the gaps.
2. Who owns Rally
Rally is designed, built, owned and operated by SentinelGrid. That includes its software and source code, its game modes, artwork and characters, its design, the name “Rally”, and the addresses it is served from. It runs on SentinelGrid's own infrastructure and accounts.
Rally is not a product of, and is not owned by, any school, school district, teacher or other school employee. Using Rally does not change that, however it is used: hosting games in a classroom, adopting it across a school, recommending it to colleagues, suggesting a feature, or reporting a bug. None of those transfers or creates any ownership interest in Rally.
What a school or teacher receives is a limited, non-exclusive, non-transferable, revocable permission to use Rally under these terms. It is permission to use a service, not a share of it.
If you send us an idea or feedback, we may use it freely and without owing you anything for it, and sending it does not make you an owner of Rally or of anything built from it. The only thing that can change any part of this section is a written agreement signed by SentinelGrid that says so expressly.
3. Who may use Rally
Teacher accounts require a SentinelGrid portal account. There is no public sign-up. Teachers must be adults.
Students need no account and agree to nothing; a student joining a game is doing so under their teacher's direction, and the school is responsible for that direction being appropriate.
Using Rally with students. By hosting a game for students, a teacher confirms that:
- they are using Rally for their school's educational purposes, with the permission of their school or district;
- where students may be under 13, the school has authorised the use of Rally in place of individual parental consent, as the FTC allows for services used only for the school's benefit (see Children, COPPA and FERPA), and has given parents whatever notice its own policies require;
- they will not use Rally with children outside a school setting, and will not ask students to type names or other personal information into a game.
A school can tell us to stop, or ask us to delete its teachers' data, at any time.
4. Content in your account
SentinelGrid does not own, and claims no ownership of, anything you put into Rally. Question sets, questions, answers and pictures in an account belong to whoever owns them, which is you or whoever you got them from. What goes into an account is the account holder's choice alone, and so is the responsibility for it.
You grant SentinelGrid only the licence needed to store and display your content so the service can run. Nothing broader, and nothing that survives your deleting it.
You are solely responsible for having the right to use everything in your account. That applies however it got there: typed in, uploaded as a file, pasted, imported from a link to another quiz site, or copied from a textbook, a worksheet, another teacher or another website. In particular:
- Rally's import tools are a convenience for moving sets you are entitled to use. They are not permission to use anybody's material. SentinelGrid does not check who owns a set, and a set importing successfully says nothing about whether you may use it.
- Other quiz services have their own terms, and those terms may limit what you can do with sets hosted there. Following them is your responsibility.
- When a SentinelGrid administrator imports a set into your account, it is done at your request and on your instruction, and the set is then your content under this section like any other.
Share links
A teacher can create a link that shows one of their sets, including which answer is correct, to anyone who opens it. Creating one is a decision to publish that content to whoever receives the address, and the responsibility for who receives it is the teacher's. Rally keeps share pages out of search engines, but a link that has been forwarded, posted or pasted into a class chat is readable by whoever has it.
Saving a shared set makes an independent copy in the recipient's account. It does not transfer any rights in the material, and the section above applies to the copy exactly as it applies to anything else: having a link is not the same as having permission to use what is behind it.
A teacher can stop a link at any time. Stopping it does not reach copies already saved by other people, and SentinelGrid cannot recall them.
SentinelGrid does not review, edit, approve or endorse content before it appears in a game or on a share page. Content in an account reflects the account holder, not SentinelGrid.
To the extent the law allows, you agree to defend and compensate SentinelGrid for claims, losses and costs that arise from content you put into Rally, including a claim that it infringes somebody else's rights.
Names for grading
A teacher may add students' names to a finished game's report in order to grade it. Those names are stored only in that teacher's browser and are never sent to SentinelGrid, as the Privacy Policy describes. Because they never reach us:
- the teacher and their school are responsible for them, for the device they are on, and for any grades file downloaded from Rally, under the school's own rules for student records;
- SentinelGrid cannot recover them if the browser's data is cleared or the device is lost, and cannot delete them on anyone's behalf;
- a teacher should add names only on a device their school allows for student records, and should not use a shared or public computer.
Do not put personal information about students into question text. It would then be stored as content, which is the one way to get student data into Rally that Rally cannot prevent.
5. Copyright complaints
If you believe something in Rally infringes your copyright, write to privacy@sentinelgrid.us with:
- your name, postal address, phone number and email address;
- the work you believe is being infringed;
- where the material is in Rally, in enough detail for us to find it;
- a statement that you believe in good faith the use is not authorised by the owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner;
- your physical or electronic signature.
On a complete notice we will remove or disable the material and tell the account holder. An account holder who believes it was removed by mistake may send a counter-notice to the same address, and we will handle it as the law requires. SentinelGrid will close the accounts of people who repeatedly upload material they have no right to use.
6. Acceptable use
Do not use Rally to harass anybody, to distribute unlawful or harmful material, to attempt to breach its security, to disrupt other schools' games, or to extract data at scale. Do not attempt to circumvent scoring, and do not use automated clients in place of students.
Teachers can remove a player from a game at any time. SentinelGrid may suspend an account that is being used to break these rules.
7. Availability
Rally is provided as-is. We aim to keep it running during school hours and we do not promise a specific uptime unless a signed agreement says otherwise. Games are live sessions: an interruption may end a game in progress, and scores from an interrupted game may be incomplete.
We may change or discontinue features. We will give reasonable notice of a change that removes something schools depend on.
8. Scoring and fair play
Scores are computed by SentinelGrid's servers from the answers students gave. Rally flags runs that look unusually fast for a teacher to review, but it does not alter or void anyone's score automatically, and a flag is not an accusation. Decisions about a student's conduct belong to the teacher, not to the software.
9. Data
Our handling of data is described in the Privacy Policy, which forms part of these terms. For schools, Children, COPPA and FERPA describes the roles the parties take.
10. Liability
To the extent the law allows, SentinelGrid is not liable for indirect, incidental or consequential losses arising from Rally, and total liability for any claim relating to Rally is limited to the amount paid for it in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.
Rally is a classroom activity tool. It is not an assessment system of record. The marks on a report and in a downloaded grades file are a count of correct answers from one live game, offered as a convenience; whether and how they count toward a grade is the teacher's decision, and they should not be the sole basis for a grade or a decision about a student.
11. Ending
A teacher may stop using Rally at any time and delete their content from within the app. SentinelGrid may suspend or end access for a breach of these terms. Sections that by their nature should survive do, including who owns Rally, content in your account, liability, and this sentence.
12. Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, unless a signed agreement with your school says otherwise.
